The Right Focus on Tort Reform

By Richard Martin The recent headlines about Merck’s Vioxx withdrawal and the FDA’s move to ban ephedra have brought a lot of media attention to the growing area of drug litigation. On April 12, 2004 the FDA published a rule banning health supplements that contain ephedra alkaloids. The FDA concluded that the limited short term weight loss effects were outweighed by possible heart problems and stroke risks. The market gap caused by the banning of ephedra has been filled by many new companies that are marketing products similar to ephedra. However, these ephedra alternatives may not be any safer than the banned ephedra that they replace. The FDA’s ephedra ban, and Merck’s Vioxx withdrawal have been hot news topics. These drug recalls and ephedra banning have brought lawsuits from many different angles. Obviously, some people think that some of the lawsuits will be frivolous. In fact, there has been a lot of news during the last decade about frivolous lawsuits brought by injured consumers against large companies for defective products. However, according to one report from Public Citizen (http://www.citizen.org/congress/civjus/tort/myths/articles.cfm?ID=12369 ), businesses file many more times the amount of lawsuits than consumers do and are more likely to be sanctioned by a court for bringing a frivolous claim. State governments have enacted tort reform which has capped potential damages for certain types of claims in some states. George W. Bush’s state of Texas implemented tort reform in 2003 to cap medical malpractice liability. George W. Bush has continued to push for tort reform nationwide since he took office. The real question is, if businesses are the ones who are generally taking too much of our courts’ time- why has there been such a push for individual tort reform? Is it possible that injured individuals are not a group of organized people with continuous business interests that actively lobby for tort reform? To some community is a relatively large geographical location: the town or village where we live. To others its a much smaller place where we live with othersperhaps a nursing home, assisted living site or a monastery. Regardless, community has to do with how we relate to those around us. There are five elements thattaken from the Buddhist definition of sangamake sense to me as they relate to any community. First is commitment. In this sense it involves examining the life we lead without the filters of ego, wealth, fame, knowledge, and position. It refers to the way we are with one another; being versus having. Next is surrender, which in this context has to do with embracing the truth about every day life. When we surrender in this way we spend less energy denying when things are not going so well while at the same time becoming more grateful and open to celebration of the good stuff of life. In fact, we are more open to all of it — the unknown. The third idea on my list is serving. This is the concept that encourages us to do what needs to be done right now and not leave any traces. It allows me to set aside my likes and dislikes and to do the dishes or pick up trash beside the road with care. In this frame of mind, its not unfair it just is. Next is acceptance and harmony: an effort to accept all folks as they are and try to build trust with another human — especially the ones who rub me the wrong way. There are experiences that are common to all of us and my community-building skills are better when I consciously look for them. The fifth and final component of that Buddhist definition of community is humanity and respect. With this in mind we are asked to give up the idea of being better-equal-lesser than another. We are human beings and can respect one another on that level, even if on no other. I offer this as another way to think about the ways in which each of us relates to those around us. Connections feel better than walls. In addition, while I think that, on some level, each of us is extraordinary in our own way it is important for me to remember that our ordinariness can be equally lovely. It is a reassuring thought that makes me feel connected to something bigger even when my image, status or well being feels threatened. And thats freedom. Tips For Selling at Craft Shows

By Laura Kay About the only thing I enjoy more than creating my bead jewelry at home is selling my bead jewelry at local craft shows and fairs! I’ve attended hundreds of craft shows and partipated in fair number myself. I am always dismayed, however, to see beautiful jewelry and pieces that don’t sell at shows simply because the artisan forgot some very basic rules of working at craft shows. Here are some of the helpful pieces of advice and tips I can offer to the beginner bead jewelry artist and anyone else who is just starting out selling to craft shows: 1. Know Your Audience: Try to get a sense of what sort of crowd you are going to encounter at your upcoming craft show and cater your inventory to that crowd. While visiting the show each year is the best way to learn this, there are other methods you can use. Is the town where the craft show being held largely upper class or middle class? You might want to adjust your pricing accordingly. Are the customers going to be children or older people? If the craft show is near or in a school I almost always bring along a few “Kid Displays” where I place all my small plastic bead jewelry. I’ve had more than one child drag her parents over to my table to see the pieces I put out especially for them. If you’re going to be showing in or around a nursing home you might want to consider changing your inventory. Older customers love beaded eyeglass chains, bracelets with large, easy clasps and “smoother” beads that aren’t sharp on when laying against bare skin. 2. Use Business Cards: Every time I sell a piece of jewelry at a craft show I package it in a neat little bag with my business card inside. I do this because even though I already sold a piece of jewelry, I often have people contacting me weeks, months and even years later to see if they can order the same or similar pieces for friends and relatives. I also list my website on the cards to people can browse and by my items in the comfort of their own home! 3. Be Flexible with Pricing: This also goes back to knowing your audience. I generally do not put price tags on any of my pieces. This way people need to ask about pricing and I can adjust my price up and down a few dollars on the fly, based on the type of audience, the size of the crowd and whether or not I really want to sell the piece. And, yes, my prices sometimes change throughout the day. Some people come to craft shows expecting to haggle, so it’s sometimes wise to quote a price a few dollars more than you might normally ask so you have some bargaining room. Though you may be uncomfortable with this at first, I find it to be very helpful. I can’t tell how you many pieces I’ve sold only after talking with the customer and chatting about the price. One of my favorite methods is to sell a pair of earrings with a beaded bracelet for only a few dollars more. The customer likes getting a “bundled” deal and I like selling two pieces and making a little extra profit. 4. Accept Checks and Credit Cards: Cash is obviously preferred, but checks are easy to accept. In all my years of going to craft shows I’ve never been cheated by someone bouncing checks. Many people bring cash to craft shows, but sometimes there are just so many great things that by the time the person gets to your booth she might not have anything left! Credit Cards are a little trickier. If you’re going to verify the credit card then you’ll need an electric source and a telephone connection of some sort. A lot of people, myself included, will often just use a manual credit card swiper with carbon paper. No electricity is needed, you just enter the numbers into your computer or electronic machine when you get home. To accept credit cards you’ll probably need a merchants account and I’ve found that most local banks can help you out or point you in the right direction. It really isn’t very expensive to do. I set up my first account and bought my manual swiper and carbons for less than $50. Selling your bead jewelry at craft shows is an amazingly fulfilling experience and a great ego booster, not to mention a fun way to make some extra money. By James Penn The earliest inhabitants of the Caribbean islands were the three Indian tribes of Arawak, Carib, and Taino. Their daily food comprised of vegetables and fruits. It was the Taino tribe that first started cooking meat and fish, using large clay vessels for this purpose. The Arawaks took a different way and used thin strips of green wood to cook meat more slowly and allowing it to absorb the flavor of the wood. The wooden grate they used was called barbacoa and now you know where the term barbeque comes from. Not to be left behind, the Carib tribe made their fish and meat recipes really spicy by adding pepper sauces, lime, and lemons. In fact, the Caribs are credited with having cooked the first pepper pot stew. The last of the above three has had a tremendous impact on Caribbean food, which should not be surprising because the Caribbean Sea was named after this tribe. In the present day, Caribbean food is still a representative of the food that was originally eaten by the early inhabitants and includes okra, fish cakes, callaloo, ackee, salt fish, pudding, souse, cassava, yams, sweet potatoes, plantains, and mangoes. The concept of “jerk” cooking has also originated in the Caribbean when early African hunters would often leave their homes to go on long hunts and take with them pork cooked in a very spicy recipe over hot coals. In the post-slavery era, Indian cooking culture was introduced in Caribbean food recipes and still remains an active part of the Caribbean cuisine. Most of the curried meats and curry powder recipes that are found today are directly derived from original Indian cuisine. Rice was introduced to the Caribbean by the Chinese and is now a staple. The Chinese also unleashed mustard on the islanders while the Portuguese sailors did the codfish. Most of the fruit trees that are familiar to the visitors to the island were actually brought here by the Spain and include orange, ginger, lime, figs, plantains, sugar cane, tamarinds, grapes, and coconuts. America brought with it the various beans, squash, corn, tomatoes, potatoes, and chili pepper to the island.
